- The “Pass Promise”
Jamworks Ltd. (“We”, “Us”) offers this conditional money-back promise (“The Promise”) to eligible students. We are committed to your academic success. We promise that if you fully comply with the usage requirements and act in good faith throughout your studies, but are not deemed eligible by your institution to progress to your second year of study, we will refund 100% of your qualifying subscription fee.
- Eligibility
To be eligible for The Promise, you must:
- Be a registered, first-year undergraduate student at an accredited university or college in the United Kingdom or the United States.
- Purchase a qualifying Jamworks subscription plan between August 14th – October 31st and continue to subscribe throughout the duration of the first-year of study.
- Not have previously held a Jamworks subscription.
2.1. Compliance with Recording Policies
You are solely responsible for ensuring you are permitted to record your lectures and seminars. You must comply with all applicable laws, university policies, and any specific instructions from your professors regarding audio recording. If you are enrolled in a course or attend an institution where recording is not permitted, you are ineligible for The Pass Promise.
- Usage Requirements (Your Commitment)
To qualify for a refund, you must meet the following criteria for your full academic year:
- 3.1. Recording Requirement: You must use the Jamworks app on your personal device (e.g., laptop, tablet, phone) to record at least 90% of all your scheduled lectures and seminars.
- Clarification: This rule exists to ensure active, consistent engagement with course material via our platform. For this reason, recordings made via third-party integrations (e.g., Panopto or Zoom cloud recording syncs) do not count towards the 90% requirement.
- 3.2. Recommended Study Practice: We strongly recommend spending at least one (1) hour per week studying with your JamAI Personal Tutor for the best learning outcomes.
- How to Make a Claim
- 4.1. Claim Period: Claims must be submitted within thirty (30) calendar days of the official date you are notified by your institution that you cannot progress to your second year.
- 4.2. Required Documentation & Consent: To initiate a claim, you must provide:
- Proof of Purchase: Your Jamworks subscription receipt and email address.
- Official Timetable: Your complete, official lecture and seminar timetable for the academic year.
- Proof of Non-Progression: Official communication from your university (e.g., a letter, an email from the registry, or a status update on your student portal) confirming that you are not eligible to proceed to your second year of study due to academic reasons.
- Official Academic Transcript: Your complete, official transcript for the academic year showing final grades for all modules/courses.
- By submitting a claim, you explicitly consent for Jamworks to use these documents for the sole purpose of verifying your eligibility for The Promise. All data will be handled securely in accordance with our Privacy Policy and will be permanently deleted upon resolution of your claim.
- Claim Verification & Refund Process
- Our team will review your claim by cross-referencing your submitted documents with your account’s recording data.
- We will not contact your institution without your separate, explicit written consent, which we may request only if necessary to verify document authenticity.
- If your claim is approved, a full refund will be processed within 30 business days.
- General Conditions & Definitions
- Good Faith: This Promise is void if there is evidence of fraud, abuse, or if non-progression is due to academic misconduct as determined by your institution. The Promise is intended for students genuinely engaging in their studies.
- “Academic Year”: Defined as the period from the first official day of teaching to the final official day of exams for two complete semesters or three complete terms.
- Definition of ‘Failing to Progress’ in the US: For the purposes of The Pass Promise in the United States, ‘failing to progress’ to sophomore year is defined as a student receiving official notification from their accredited institution that they are not eligible to register for the subsequent fall semester as a full-time, second-year student at this institution due to not meeting the university’s requirements for academic progression. This includes, but is not limited to, official university statuses such as Academic Suspension or Academic Dismissal. The student must provide official documentation from their institution (e.g., a letter from the registrar’s office, official student portal status) confirming this outcome.
- “Pass the Year” / “Progression” in the UK: Defined as being deemed eligible by your academic institution to enroll in the second year of your registered undergraduate degree program. Any outcome where you are not eligible to progress is considered not passing the year for the purpose of this Promise.
- Jamworks Ltd. reserves the right to modify or terminate this Promise at any time; however, changes will not affect eligible users who purchased their subscription while The Promise was active.
